The volume of distress in the UK’s real estate market has continued to increase in 2023 with fixed charge receivership appointments increasing by 83% this year compared to 2022. The real estate market has also been troubled by increasing interest rates, rising costs and pricing uncertainty, all of which have made this a challenging landscape for lenders to circumvent.

In a recent webinar hosted by Kroll and Five Paper, our experts provided a review of possession actions after lending with a particular focus on the common strategies for enforcement and defenses in mortgage possession. We also provided a review of the Debt Respite Scheme which was introduced in 2021 with an aim to provide “breathing space” for those in financial difficulties and to encourage them to seek advice and assistance and to ensure that those in a mental health crisis are given some protection.
